Terms and Conditions
The basis of the legal relationship between the Participant and Placement Year International is listed below.
1. Definitions
The terms of this agreement are defined as follows:
The Company: Placement Year International Ltd and any person with whom they have a partnership agreement.
Applicant: Any person who fills out an application form and / or Booking Form online and has an interview with a The Company representative. This person is free of any obligations up until the point of paying the Acceptance Fee (post interview)
Participant: Any person whom The Company has accepted to provide its services for after receipt of the Acceptance Fee.
Programme: The service which the participant applies for (internship, work placement)
Position: The tasks and description of the programme of the Host Company provided to the participant by The Company.
Host Company: Refers to the Hotel, Travel Agency, Restaurant, School, Business or Institution partner of The Company where The Applicant will have the opportunity to do an internship placement.
Agreement: Any arrangement made between The Company and the participant or any change that follows.
2. Inclusions and exclusions
2.1 Included in all placements:
- Internship placement or TEFL course in your chosen destination.
- Assistance with appropriate visa application.
- Advice from our offices to help you prepare for the programme.
- Contact person in our UK Head Office.
- 24 hour emergency telephone number in the UK.
- 24 hour emergency telephone number in your destination.
- Co-ordination of transfers on arrival in your destination (at our recommended airport or equivalent, small additional charges may apply).
- Orientation on arrival.
- Support and advice from local staff throughout programme.
- Certificate upon completion of the programme.
2.2 Exclusions:
- Flight
- Visa fees
- Travel, Health & Personal liability insurance
- Local transport cost
2.3 Please refer to country-specific Terms & Conditions below for additional inclusions and exclusions that apply to specific Programmes.
3. Booking/Application process
3.1 Participants apply using the online Booking Form. The application is binding for the Participant after The Company receives the completed Booking Form.
3.2 The Company reserves the right to accept or reject applications. Agreements deviating from any of the below mentioned terms and conditions require written confirmation by The Company.
3.3 The Company charges a £200 Acceptance Fee which is paid at the time of completing the online Booking Form. The Acceptance Fee is charged to ensure participants are committed to the programme and is only refundable if The Company is unable to arrange a placement they consider suitable for the participant. It is not refundable if participants change their mind and withdraw from the programme for their own personal reasons.
3.4 Proper Law and Jurisdiction – the proper law of the contract between The Company and the intern is English Law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with the contract.
3.5 The host company has the right to make internal organisational changes that may result in programmes changing or being withdrawn altogether. In these rare situations The Company will endeavour to confirm the scope of any revised programme still meets your requirements or arrange an alternative programme.
3.6 The Company is not liable for the results of the participant before the programme. If in any case, school/college/university results have influence during the programme period or before the start date of the programme, the participant is still charged the full programme fee.
3.7 The Company will send participants a Certificate of Completion after finishing the programme.
4. Responsibility and other matters
4.1 All applications are accepted on the understanding that applicants join the programme at their own risk. The Company cannot be responsible for the actions or omissions of those involved in the programme over whom we have no direct control, such as employees of airlines, transport undertakings and others. Equally the Company cannot accept liability or responsibility for loss or expense due to war, riots, strikes, terrorist activities, natural disasters, or bankruptcies (or similar) of unconnected third parties amounting to a force majeure. The Company is not liable for any injury, damage, loss, accident, delay, or other irregularity which may be caused by defect of any vehicle or other equipment, other than its own, or the negligence or default of any company or person engaged in carrying out or performing any of the services involved, other than our own staff.
4.2 The Company gives Participants all reasonable assistance to obtain visas, visa renewals and work permits, when they are needed. All advice is given in good faith according to regulations at time of application. Whilst the Company can assist with the visa application process, visa arrangements are between individuals and a state, and are not within control of the Company. If at any time the National authorities change the visa regulations, the Company will endeavour to contact any affected persons as soon as is reasonably possible to discuss any new requirements and offer assistance with the new process.
4.3 All services and accommodation are subject to the laws of the country in which they are provided. The Company reserves the right to make changes in the agreed programme whenever, in their sole judgement, conditions warrant, or if they deem it necessary for the comfort, convenience, or safety of the participant. The Company also reserves the right to withdraw any programme without penalty.
4.4 Without in any way limiting our entitlement under paragraph 4.1 above, in the event that The Company is advised by the UK Foreign and Commonwealth office (or, for non-British interns, your foreign ministry) that you should not travel to, or should not remain in, the destination where you have been placed, then we will assist you, where reasonably possible, to return home.
4.5 The Company reserves the right to decline to accept any person as a participant, or to require any Participant to withdraw at any time, when such action is determined by The Company to be in the best interests of the health, safety, and general welfare of the programme or of the individual Participant. In such a case, The Company accepts no responsibility for any airline cancellation penalty incurred by the purchase of a non-refundable ticket or any other cost that may be incurred and shall not be required to return any fees paid by the Participant.
4.6 Dates, schedules, programme details and costs are given in good faith, based on information available and in force at the time they are given and are subject to change and revision in the event of a change of circumstances. In the event that The Company is unable to provide the agreed internship placement we will endeavour to provide an alternative and are not responsible for any consequential losses which may be incurred.
4.7 The participant shall be responsible for and held liable for all of his or her acts along with any loss or damage that results from those acts while he or she is on the programme. In the event that The Company, its affiliates, and or any respective employees, agents and representatives of any of these entities suffer any loss or damages as a result of the acts of the participant, then the participant agrees to indemnify the party that suffered such loss or damages. Such claims for indemnification shall cover any and all reasonable claims, causes of action, judgments, losses, costs or expenses which may be made against any of the parties listed or which said parties may suffer or incur as a result of or relating to any acts of the participant.
4.8 Each Participant must take full responsibility in the event that laws, regulations, or customs are broken, regardless of foreknowledge.
4.9 The information provided on the Booking Form, Placement Questionnaire and other forms is to the best of the Participant’s knowledge complete and correct and the Participant understands that The Company shall have the right to terminate the Programme at any stage if proven otherwise. Should any changes occur at any time before and during the Programme, the Participant agrees to inform The Company immediately.
4.10 The Participant may not sell or transfer their Programme to a third party.
5. Complaints and Disciplinary Procedures
5.1 The Company will be flexible, helpful and friendly, and will advise and support Participants with their work wherever possible. Nevertheless, formal complaints procedures (by Participants) and disciplinary procedures (by The Company) are necessary, and these are laid out below.
5.2 Complaints
5.2.1 Complaints about procedures leading up to departure should be raised with our UK office on +44(0)1273 725868 in UK office hours, or by email to: [email protected] where it will be dealt with as quickly as possible. During a programme, the Participant must show a high level of independence and initiative in dealing with problems as they arise. If there is a problem or complaint to do with the placement, the matter should be discussed with the placement supervisor in the first instance. If, after this the matter remains unresolved, it should be brought to the attention of The Company’s local manager or representative. Any complaint made to The Company will be documented and responded to. Individual situations are then discussed and resolved appropriately. For matters that cannot be resolved in-country, the UK head office should be notified.
5.2.2 If the participant chooses to leave the programme earlier than the original agreed dates, they must inform, in writing, both The Company and the Host Company.
5.2.3 Your withdrawal is valid on the date it is received by The Company and / or the Host Company.
5.3 Disciplinary procedures
5.3.1 Every reasonable effort will be made to resolve any disciplinary matter before it becomes serious. However, we reserve the right to take appropriate action in the event of behaviour which would reasonably be expected to give offence to the host company, their clients, work colleagues, other interns and hosts. This includes behaviour such as serious rowdiness or drunkenness, failure to turn up to work, or leaving work without any adequate reason, or in the event of an unreasonable inability, from whatever cause, to do the work expected.
5.3.2 If The Company agrees that there is an unacceptable amount of incompatibility between you and the Host Company and we consider it the right decision to change your placement, it may be necessary for you to stay in alternative accommodation for a short time. While The Company may be able to recommend suitable alternative accommodation, the participant is responsible for arranging and paying for this temporary accommodation and food.
5.4 Termination by the Host Company
5.4.1 While The Company encourages all partner Host Companies to notify Participants and The Company in case of any problems with individual Participants, the Host Company may terminate placements at any time, without prior notification, with or without cause. The Company is not responsible for and cannot control decisions made by Host Companies. The Company will endeavour to arrange an alternative Host Company but this is not a firm offer and The Company is not responsible for your food and accommodation between Host Companies. It would be at the discretion of The Company and The Host Company to suspend a participant from work during any disciplinary process.
5.4.2 The Company is not liable for the performance of the Participant during the programme period at the Host Company. If the participant gets dismissed from their position due to the fault of the Participant, The Company can try and find another programme placement, for an additional fee, if this is possible within the Participant’s visa limits. The Company cannot guarantee an alternative placement, and cannot accept responsibility for any losses to the participant due to their dismissal.
5.4.3 The Company will not be responsible for any costs incurred in making arrangements for early repatriation. Should the Participant wish to stay in the destination country after being dismissed from their placement, and does not wish to seek another one, The Company would have no further responsibility for the internship, accommodation, food, visa and travel arrangements.
6. Health and Insurance
6.1 The Participant must arrange sufficient insurance for the duration of their programme. It is a mandatory requirement that Participants be covered with an international insurance plan, covering travel, health and personal liability insurance, for the duration of their programme with The Company.
6.2 It is the responsibility of the Participant to declare any pre-existing medical conditions or medication to the insurance company.
6.3 The Participant must take responsibility for their health and well-being when on the programme. It is the Participant’s responsibility to ensure they are fit to travel and work overseas, and they should seek the advice of their GP or medical practitioner in advance of their trip regarding any additional precautions that may be needed.
7. Payment schedule
7.1 An Acceptance Fee of £200.00 is to be paid at the time of completing the online Booking Form. This fee is non-refundable, except in the instance that The Company is unable to arrange a placement they consider suitable for the Participant.
7.2 A 1st Installment of £300 is to be paid within 3-4 weeks of the Participant being accepted on to the programme by The Company. This amount is deducted from the main Placement Fee, not in addition to it. The 1st Installment is refundable, in the instance that The Company is unable to arrange a placement they consider suitable for the Participant, but not if the Applicant cancels/withdraws his/her application for a programme.
7.3 Upon receipt of a confirmed placement offer, or 3 months before the Participant’s start date, whichever comes first, the Participant will be invoiced for the placement fees, to be paid within 7 working days, unless otherwise agreed in writing with The Company. This is to ensure that visa applications and necessary paperwork can get underway.
7.4. For Participants on the Australia programme who booked placements lasting more than 6 months, The Company will arrange 2 host companies (1 for the 1st 6 months, and another for the remainder of the placement duration). The full placement fees will be paid by the Participant when The Company confirms the 1st placement.
8. Cancellation, changes and Refunds
8.1 Changes
It is not always possible to make changes to a placement once the offer letter has been accepted. In the cases where changes are possible, The Company reserves the right to charge an amendment fee to the Participant, which is normally £75, plus any costs incurred by the Company. If an amendment fee is to be charged, The Company will provide the Participant with a quotation before proceeding.
8.2 Cancellation
8.2.1 Cancellations must be given from the Participant to the Company in writing (email to [email protected]). Charges incurred depend on how far in advance of your stated departure date The Company has been informed in writing. The stated departure date refers to the date specified in the Participant’s Acceptance email. Programme fee cancellation conditions are as follows:
a) Cancellation by Participant after Placement Confirmation (receipt of a programme offer in writing) and payment of the Acceptance Fee and 1st instalment, but before balance payment: payment of 50% of outstanding balance.
b) Cancellation by Participant after Placement Confirmation (receipt of a programme offer in writing) and payment of the Acceptance Fee and Placement Fee: NO REFUND
c) Failed visa application (Refusal by the Embassy or General Consulate forcing cancelation): REFUND of 50% of the fees (minus Acceptance Fee, and minus any fees paid for the visa which cannot be recovered)
d) No refund will be made for any reasons if the Participant provides false or fraudulent information / documentation.
e) No refund will be made for any reasons after a Programme has commenced in-country.
8.2.2 Exceptions are entirely at the discretion of The Company and must be agreed in writing at the time when any postponement or cancellation is made.
8.3 Refunds
8.3.1 Refunds, if applicable, will be processed within 28 days of The Company receiving notification of cancellation in writing from the participant.
8.3.2 The Acceptance Fee is only refundable in full in a case in which The Company cannot offer a placement to a Candidate (Providing none of the points in 8.3.3 apply).
8.3.3 The Acceptance Fee and Placement Fee (which includes the 1st installment mentioned in 7.2, above) are non-refundable in any of the below cases:
- Applicant cancels/withdraws his/her application for a programme.
- Applicant has been provided with 1 or more interviews with hiring host companies.
- Applicant has received a suitable programme offer and has refused such offer.
9. Placements in China
9.1 Hospitality Placements in China
The following terms and conditions (section 9.1) apply to all participants doing a hospitality placement in China.
9.1.1 Once a participant has been accepted on the programme, The Company will present their application, including CV and covering letter, to one or more of our host companies, which have been specifically selected by The Company. Selection is based on educational training, skills, experience, personal and university requirements. If selected, the host companies will request a video interview with the Participant.
9.1.2 Before starting a work placement, all participants will complete a Mandarin language course at Jiangnan University in Wuxi. Accommodation is provided for 1 month. Also included is the cost of a local medical check-up, the charge of changing the Student X visa into a Temporary Residence Permit and international postage of the visa invitation letters from China to the Participant’s home country. Food is available locally but is not included during this period.
9.1.3 After starting the Programme, accommodation and meals are arranged by the Host Company and are included free of charge for the duration of the internship (The Company will advise you of any exceptions in advance). Accommodation is in individual or shared same-sex rooms. Most of the rooms are simply furnished in either the Host Company’s own accommodation or in the vicinity. Our local staff do their best to check all accommodation meets normal European cleanliness and safety standards. Full accommodation details will be sent out to the participant before they arrive in the destination. Food includes three meals a day that are normally served in the staff canteen unless alternative arrangements are made by the host company; The Company will endeavour to inform participants of these before starting the Programme.
9.1.4 The Company provides all reasonable assistance to obtain visas, visa renewals and work permits, when they are needed. All advice is given in good faith according to regulations at time of application. Whilst The Company can assist with the application process, visa arrangements are between individuals and a state, and are not under our control. If at any time the Chinese authorities change the visa regulations, The Company will endeavour to contact any affected persons as soon as is reasonably possible to discuss any new requirements and offer assistance with the new process. Participants usually obtain a Student X visa which is issued on the basis of their participation on a Mandarin language course with Jiangnan University, Wuxi. If the Participant leaves the programme for some reason and intends to remain in China, they must continue the language course for the visa to remain valid. If the Participant leaves China before completing the language course, no refund will be given for any remaining lessons.
9.2 Paid Teaching in China
The following terms and conditions (section 9.2) apply to all participants doing a paid teaching Programme in China.
9.2.1 Upon receipt of a confirmed job offer, the participant will be required to sign a work contract with our partner company in China. This will be emailed to you along with any relevant instructions. The agreement will detail the terms and conditions of the contract and will include the dates of employment, the salary and/or living allowance, any holiday entitlements and/or benefits.
9.2.2 In the event that a participant does not complete their TEFL training for any reason, the programme fee is not refundable, except under the terms of the refund policy (above).
9.2.3 Benefits
9.2.3.1 The Host Company shall reimburse the Participant for their return flight ticket from home country to China. The Participant must book the flight according to schedules and off-peak prices, which must be approved by The Host Company prior to purchase. The cost of the flights will be reimbursed upon completion of 3 months of their paid Programme in China. The Company is not liable for any costs relating to flights.
9.2.3.2 The Participant must complete an approved TEFL course in their home country prior to the start of their programme. As long as the course is through the recommended provider (details will be sent upon acceptance), the cost of the course will be reimbursed upon completion of 1 month of their paid Programme in China. If visa eligibility depends on TEFL certificate, The Host Company shall provide the Participant with TEFL course upon signing contract. If the Participant chooses to complete a different TEFL course to the one recommended by the Host Company, the Host Company will not reimburse the cost. The Company is not liable for this cost.
9.2.3.3 As a WELCOME TO CHINA bonus, The Host Company shall provide the Participant with an optional 1 (one) Day of sightseeing in Shanghai, China. Sites and schedule will be according to The Host Company and the Participant’s days off. In the event the Participant does not want to participate in this sightseeing, no cash value will be reimbursed to the Participant.
9.2.3.4 Salary and housing allowance shall be paid on a monthly basis. Deductions will be made pro-rata for any days absent from work or tardiness.
9.2.4 Visa
9.2.4.1 The Host Company shall assist and sponsor the Participant with a valid working visa for the contract term. The Participant shall be responsible for providing The Host Company with an authenticated BA degree or above and a criminal background check from their home country. Visa fees shall be paid by The Participant. Work permit fees shall be paid by the Host Company. The Participant shall be responsible for payment for medical check that will take place in China. This is a requirement for the visa process. The medical check costs shall be reimbursed to the Participant upon completion of contract. The medical check is estimated at 600 CNY.
9.2.4.2 If the Participant is denied a valid working visa by the Foreign Expert Bureau of China or China Immigration, this contract shall be null and void. In the event this contract is breached for visa refusals, no refund will be made for any costs already incurred.
9.2.5 Obligations of Participant
9.2.5.1 The Participant shall observe the law, decrees and relevant regulations enacted by the Chinese government and must not interfere in China’s internal affairs.
9.2.5.2 The Participant shall respect administration personnel, assistants and follow the Host Company’s regulations, complete tasks on time and ensure the quality of work.
9.2.5.3 The Participant shall respect China’s religious policies, and shall not conduct religious activities considered inappropriate in China.
9.2.5.4 The Participant shall respect the Chinese people’s moral standards, conventions and customs.
9.2.5.5 If the Participant requests sick leave, a doctor’s sick note (illness report) must be provided.
9.2.5.6 The Participant will work for 40 hours ,which is for 25 hours teaching + 15 hours prep time (including but not limited to teaching, assisting teaching, preparation, peer discussion, pupils review) per week depending on the Host Company’s arrangement; The Participant agrees to vary work hours or days for reasons relating to teaching needs.
9.2.6 Contract
9.2.6.1 The contract will be between the Participant and the Host Company. Both parties are required to give one month written notice to terminate the contract.
9.2.6.2 If either the Participant or the Host Company fails to fulfill the contract or fails to fulfill the contractual obligations according to the terms stipulated in the contract, the one at fault must pay a penalty of 8,000 CNY to the other party. The Company is not liable for this cost.
9.2.6.3 The contract is valid from the date when it is signed by both parties and will automatically expire when the contract ends.
9.2.6.4 If either of the two parties requests a new contract, they should notify the other party 60 days prior to the expiration of the contract and sign a new contract with mutual consent.
9.2.6.5 The contract will automatically expire if The Participant’s visa cannot be renewed, the policy of visa application changes or the documents of the Participant are no longer accepted by the authorities. Neither The Company, nor the Host Company are liable if the Participant’s visa is rejected by the visa authorities of China.
10. Placements in Thailand
10.1 Hospitality Placements in Thailand
The following terms and conditions (section 10) apply to all participants doing a business, hospitality or sports & leisure Programme in Thailand.
10.1.1 The Company will provide the Applicant with offers and opportunities that provide for a paid Programme in Thailand under the rules and conditions of the non-immigrant ED or B visa;
10.1.2 The Company will assist the applicant in getting his/her visa approved to the best of its capabilities, including setting up or providing local pre-interview coaching and aid in completing all required applications and documentation; However, Embassy visa payment charges are not included in Programme fees.
10.2 Confirmation of Placement
10.2.1 Upon acceptance onto the Programme, participants will be required to sign an agreement on the specific terms and conditions of their Programme. The Company will introduce the Participant to its partner in Thailand, and they will then be invited to attend a video interview (or in some cases this may be done via email) to find out more about the specific requirements of their Programme. They will be in charge of introducing the Programme to the Host Companies.
10.2.2 The Participant may be required to attend a video interview with one of our hiring managers for Thailand (it may happen that a hire be confirmed without the need for a video interview).
10.2.3 Once an offer is made, The Participant will receive a programme Offer Letter in writing from The Company, which will need to be accepted within 3 working days.
10.3 Arrival Coordination
10.3.1 Once your visa is granted and Programme confirmed, we will contact you to discuss your flight arrangements and arrival process, and to confirm your accommodation arrangements.
10.3.2 During the programme the Participant must follow the Host Company employment rules and terms of the training programme throughout his/her time in Thailand. The participant accepts that the placement is for full time employment, usually of 5-6 working days per week, and for working approximately 8 to 10 hours per day.
10.3.3 The Participant will receive advice for their Visa Extension which may be processed in Thailand or a neighbouring country, depending on the Participant’s nationality.
10.4 Additional Expenses
The following are expenses to be paid for directly by The Participant and that these are not included in the Programme fees with The Company:
- Visa Application Submission and related fee (normally around 80USD) with the Royal Thai Embassy or Consulate Abroad;
- Return International Airfare to/from Thailand + Domestic Travel within Thailand;
- International Accident, Travel and/or Health Insurance Protection. It is MANDATORY that every Participant is covered with an international insurance plan while in-programme with The Company
- The 1st 1 or 2 nights accommodation & food if The Participant chooses to arrive earlier than the Programme start date.
- Consular Documents Authentication (Public Notary or Consular Services) with the local Embassy and the Thailand Ministry of foreign Affairs in Bangkok.
- Visa Extension travel if required to be made outside of Thailand (at the Royal Thai Embassy in Singapore, Hong Kong or Malaysia)
- Personal expenses including but not limited to: Medical check-up, Public Notary Services, Obtaining a passport, Criminal record check, Drug test, Courier of documents, off-duty meals are not always provided by host companies but can be bought cheaply in local restaurants near your accommodation using your salary (this will be confirmed in the offer letter from your host company);
- Travel to Bangkok (for participants with Host Companies which are not in Bangkok) for requesting your “Embassy Support Letter” (process done during the 3rd month in Thailand)
10.5 Paid Teaching placements in Thailand
The following terms and conditions (section 10.5) apply to all Participants doing a TEFL Course with Teaching Job Guarantee in Thailand.
10.5.1 Upon acceptance onto the programme, participants will be required to sign an agreement on the specific terms and conditions of their TEFL programme in Thailand.
10.5.2 The Company will assist the applicant in getting his/her visa approved to the best of its capabilities; Embassy visa payment charges are not included in programme fees.
10.5.3 The Programme consists of a 120 hour, 4 week TEFL course and Teaching Job Guarantee. The participant must agree to complete all assigned course work and teaching practices. Upon successful completion of the course the participant will receive assistance finding a job offer for a paid teaching role.
10.5.4 In the event that a participant does not complete the initial TEFL training for any reason, the Programme fee is not refundable, except under the terms of the refund policy (above).
10.5.5 The standard working week is Monday to Friday. On Occasion, the Host Company may postpone a normal study-day to a Saturday or Sunday in the event of National Holidays or any unforeseen event or occurrence.
11. Placements in Vietnam and The Maldives
The following terms and conditions (section 11) apply to all Participants doing a Programme in Vietnam or The Maldives.
11.1 Upon acceptance onto the Programme, Participants will be required to sign an agreement on the specific terms and conditions of their Programme.
11.2 The Company will assist the Applicant in getting his/her visa approved to the best of its capabilities, including setting up or providing local pre-interview coaching and assist in completing all required applications and documentation; However, Embassy visa payment charges are not included in Programme fees.
11.3 Confirmation of Placement
11.3.1 The Company will introduce the Participant to its partner Host Companies in Vietnam or the Maldives. The Participant may be required attend a video interview with one of our hiring managers for Vietnam and the Maldives (it may happen that a hire be confirmed without the need for a video interview).
11.3.2 Once an offer is made, The Participant will receive a programme Offer Letter in writing from The Company, which will need to be accepted within 3 working days.
11.4 Arrival Coordination
11.4.1 Once your visa is granted and Programme confirmed, we will contact you to discuss your flight arrangements and arrival process, and to confirm your accommodation arrangements.
11.4.2 During the programme, the Participant must follow the host company employment rules and terms of the training programme throughout his/her time in Vietnam or the Maldives. The participant accepts that the placement is for full time employment, usually of 5-6 working days a week, and for working approximately 8 to 10 hours per day.
11.4.3 The Participant will receive advice for their Visa Extension in Vietnam or the Maldives. The cost of the visa may sometimes be covered by the host company, however any travel required to obtain the extension will not be covered and will have to be paid for by the Participant.
11.5 Additional Expenses
The following are expenses to be paid for directly by the applicant and that these are not included in the Programme fees with The Company:
- Visa Application Submission and related fees
- Return International Airfare to/from Vietnam or the Maldives + any Domestic Travel
- Travel Insurance
- The 1st night stay in-country. The Company can advise on options of places to stay.
- Consular Documents Authentication (Public Notary or Consular Services) with your local Embassy and the relevant Ministry of foreign Affairs in the destination country.
- Visa Extension travel if required to be made outside of Vietnam or Maldives
- Personal expenses including but not limited to: Medical check-up, Public Notary Services, Obtaining a passport, criminal record check, drug test, courier of documents;
12. Placements in Australia
The following terms and conditions (section 12) apply to all participants doing a placement in Australia.
12.1 Visas and arrival
12.1.1 The Company will provide details of the visa application process for the participant. The intern agrees to obtain and provide to the satisfaction of The Company evidence of correct and valid visa and immigration documentation that allows them to remain legally in Australia. Such evidence must be provided to The Company prior to commencement of the Programme.
12.1.2 If in any case The Participant is refused at the border of the country of destination or any country in transit, The Company is not liable. If The Participant is going to Australia through a programme where he or she earns study credit through his or her educational institution, he or she will always have to travel on a visa. Travel on a Tourist visa is not permitted through The Company.
12.1.3 The Company is not liable for any denials of visas at the Consulate. The Company is also not liable for possible visa denial based on The Participant or Host Company.
12.1.4 If there are any political influences between the government of The Participant’s home country and Australia, or if there are any issues between the Australian government and the Australian Consulates/Embassies, The Company is not responsible.
12.1.5 The Company won't be liable in case of any visa delays. The visa application is handled by the Australian Government.
12.1.6 If there is any change in the flight to The Participant’s destination, The Company is not liable. If the Participant is not present on the start date of his or her Programme, and if the Host Company cancels the Programme as a result, The Company is not liable.
12.2 Insurance
12.2.1 The Participant agrees to obtain and provide evidence to the satisfaction of the The Company and Host Company of personal insurance cover (AUD$2million), including medical insurance, accident insurance, travel insurance and personal liability insurance, any other relevant insurance as requested by the Host Company prior to commencement of the Programme.
12.3 Accommodation
12.3.1 The Company will give advice to The Participant to help The Participant arrange their accommodation. The Participant must reserve the housing themselves.
12.3.2 The Company does not guarantee housing quality, such as facilities, hygiene, furniture, and safety. The Company is not responsible for possible damage or disturbance caused by The Participant.
12.4 Placement allocation
12.4.1 Placements are a voluntary learning experience in The Participant’s field of interest in order to gain further practical experience, knowledge, skills and exposure within an English language environment and increase their understanding of the skills involved within this field of interest. It may be an essential requirement stipulated by the The Participant’s tertiary education provider or a voluntary act by The Participant.
12.4.2 The Participant agrees and acknowledges that Australian employment legislation such as the Fair Work Act 2009, National Employment Standards, and any industrial instrument normally relating to the Host Company and their employees or business activities, will not apply to The Participant in respect of the Internship Programme. For example, The Participant is not entitled to any paid leave such as Personal/Sick/Carer’s Leave, Annual Leave, and similar leave.
12.4.3 The Programme will be on a full-time basis only unless otherwise agreed between The Participant The Company.
12.4.4 Upon the ending of the Programme, The Company and Host Company are under no obligation to offer The Participant paid employment.
